Matt Barthalow focuses his intellectual property practice on assisting clients obtain patent rights for their inventions as well as guiding clients on the patent rights of competitors. He does so while working closely with clients to ensure that his assistance addresses their business needs in an effective manner.

Matt has extensive experience in patent prosecution and client counseling across diverse technologies with a particular focus in life sciences and chemical matters. In that respect, he regularly assists clients by:

• Drafting and prosecuting patent applications for biotechnology, pharmaceutical, and chemical inventions such as those for:
  • Biopharmaceuticals/pharmaceuticals (e.g., therapeutic antibodies, small-molecule drugs, etc.);
  • Gene-editing techniques (e.g., CRISPR applications, gene therapies, genetically engineered microorganisms, etc.);
  • Medical laboratory and home-use testing (e.g., in vitro diagnostic assays/methods for biomarkers); and
  • Food and drug testing (e.g., bacterial contamination tests, plant genomic assays, etc.)
• Drafting and prosecuting patent applications for inventions in other technologies (e.g., medical devices, telecommunications, software, etc.);
• Preparing noninfringement/invalidity opinions on third-party patents including freedom-to-operate opinions for product launches; and
• Performing due diligence analyses on patent portfolios for contemplated business transactions.

Matt’s knowledge in patent prosecution and transactional matters has helped clients to build strong patent portfolios and close deals. When litigation becomes an issue, he further assists clients while working with litigation counsel to achieve favorable outcomes. 

Throughout his career, Matt has had the opportunity to lead attorney teams for particular clients and mentor new patent attorneys. He also has been invited to provide presentations on various aspects of U.S. patent law and practice, including while traveling in France, Japan, and India. 

Matt earned his Juris Doctor degree and his Master of Intellectual Property degree, magna cum laude, from the University of New Hampshire Franklin Pierce School of Law, his Master of Science degree and his Bachelor of Science degree from the University of Maryland, Baltimore County. During law school, he was an extern at the Office of the Solicitor at the United States Patent and Trademark Office, where he worked on projects related to both legal policy and appellate advocacy. Before law school, he performed scientific research during graduate school and at the National Cancer Institute (NCI) as an undergraduate.
